I laid out this possible scenario weeks ago. Personally, I don't think that the PPS has tanked enough for Calasse yet (to intentionally default or straight up pull the appeal) -ie- the PPS damage that could be inflicted by continuing to milk this. ....Looks like we will find out soon enough as far as the "default" scenario is concerned.

And by the way, I seriously doubt that Calasse has spent a nickle on this appeal ...99% of the time, these types of cases are taken on a contingency basis.
Sharp on the other hand has most likely spent a significant chunk.
On a secondary note.... Anyone know anything about the separate breach of fiduciary duty case that Sharp tossed at Calasse?

The time-frame involved here (which could wind up being quite substantial) is a real drag... But then again, I dont have a pressing need for this to get resolved any time soon. That said, there is nothing illegal going on here with WNFT where Sharp is concerned.
In spite off the time involved with the courts, my sentiment towards WNFT hasn't changed much.
But here's the good news .... No matter what happens to Mr Sharp OR WNFT, Im going feed some folks, be an asset to the community I live in.... and continue live a full satisfying life.
Either way, a fraudulent Form 4 filed by Calasse would be irrelevant at this point as it would appear that forms A1 and Heinz 57 were filed fraudulently just days ago.
The penalties for this can be quite severe .... Ive seen lifetime sentences handed down for first time offenders.

If there is anyone out here that is truly (and understandably) perplexed at how the court systems work, I would suggest that you spend an hour with a good ligation attorney and ask a lot of questions.
Given the courts recent order.. In my mind (With all of the cliches attached - Looking in the mirror - Before God...etc...etc) there are very few ways this gets resolved sooner than later.
As some know, I am married to the legal profession by proxy of my wife. I have a scenario that I bounced off of my main guy (40 years/former senior partner) and these were my thoughts and questioned put forth to him.
Me asking/theorizing:
By the time this get resolved, the shares Calasse is suing over could well be worthless.....If Calasse were to give this a few months and really let the PPS tank as this stagnates in the court system, what would prevent him from purchasing just shy of 3% of the O.S. (to avoid reporting it) for under a 100K and then ending the appeal (witch would cause this to run like hell = nice return)... On a larger scale, What would prevent him from doing this with multiple parties in unison (ie -He funds multiple parties to do as I just mentioned).
My guys answers:
Nothing... Calasse could even address the court personally (not through his council) and for for 200.00 and change snuff the appeal.... And, It is extremely doubtful that ANY entity would step in and investigate/cry foul.
However, Calasse's attorneys most likely took this on contingency and could royally sue his ass for abruptly doing so as they would be basically getting stiffed (sue his ass -based on the shares he secured and/or the sum of his returns).
Do I think Calasse would do this given the opportunity?... Absolutely.
Do I think he CAN do this?.... I dont know as I have no idea what he is made of financially.
To those that think that my theory above is a bit far fetched, I understand. ..all I can say is that I was raised by a post-depression era gangster and it is mild per the schemes I had been party to by the age of 11 (Ha... My Grandad always joked that I learned to read @ 5 yo. via the Daily Racing Form).
In my opinion, whats even crazier than my theory above, is the one where Mr. Sharp is doing the same tactic - dragging this out to buy cheap shares in his own company.
.....To that I say nonsense, I just don't believe that George Sharp is that kind of man.

Barring the extra time involved, this is not a bad thing for team sharp and is certainly not giving Calasse and sort of advantage. It is simply an extremely rare case for the court with not a lot (if any) legal precedent. ....As my guy said "it covers their ass" and I trust his experience.

Im surprised that they took this route actually... I thought that the court would either find that Calasse had no standing and dismiss the case -or- (and highly unlikely in my mind) decide that Calasse did have standing, reinstate briefing and move forward focusing on the actual appeal itself.
Evidently this scenario is such an odd bird (the "standing" issue and the mechanics of it) that the court is actually attempting to set a legal precedent here. It would appear that it (the court) has not crossed a bridge such as this one before, thus the request below.

How I feel about the "one sure thing"
I'm grateful to Mr Sharp for providing these opportunities ... He is the one laying out the time, the effort and the big money. I am confident he will see this through. I believe we have ourselves a diamond waiting to be cut and mounted here.
Personally, all I can do is hold my experience and what I think I know in one hand... And my tolerance for risk in the other.
Having legal professionals to rely on doesn't hurt either.
Ive done well with this ticker, so perhaps my sentiment is easier to stand in because of that fact.
None the less, If I didn't truly believe what I say about this ticker, I wouldn't say it (and feel very fortunate to be well enough fed to proclaim such a thing).
