bk, let me first confess that I do not know for sure. As far as I am concerned until this plays out NOBODY on this board knows for sure that can/will show proof whether the following is or is not factual.
There has been so much sealed information and blacked-out in this case, that all we can do is wait for time to pass as see what really happens in the finality.
It is my thoughts and has been since WaMu was seized that there were bids that were NEVER shown and I still believe that Susman group has proof of a bid (s) for WMIH in whole or parts.
With that said, I still think there was a deal of sorts made and will not play out until after the final claims play out. Do not talk about legalities with me about this case since the whole case was a fraud from the beginning when the judge was shopped along with Weasel/Gotcha/Mangle.
Walrath could not even penalize them a nominal ten percent for billing more hours that there are in a day. Not to mention many other illegalities in billing that several filed with the court, pointed out and discussed at length.
I have no doubts the reason Walrath has allowed claims in past the bar date which is a rarity, amend and extend claims that this was done to keep prolonging the bankruptcy case. This would lend credibility to my thoughts about a deal of sorts, but one that will not play out until the final claims are finished.
There is absolutely no reason to allow claims past a bar date unless there is some form of ulterior motive and do not even discuss feeling sorry for these poor saps when most of these so called high ranking executives ended up with employment with JPM so in fact they should not have any claim to start with. Can one mention double dipping?
This is to not even mention nonsense about not making a ruling with these claims when she could and should have. They have no recourse against the trust or even the estate and everybody knows this unless of course, one wants to drag this out four to six years. Obviously, this looks like what Walrath and her bosses from the Government/JPM has wanted.
