First let me say that I think that there is little chance that this goes back to the judge. I think Samsung is a done deal.

However, if it does go back, I dont think Samsung's behaviour will have any impact on the outcome of the case. Does anybody think that the judge wasnt done by the night before the decision was due? It is hard to imagine the judge going back and changing anything substantive based on the settlement falling through.

Revlis, the ITC, Delaware, Appeals Court and Sammy Arbitration 3/4 are all stayed at this time as a result of the parties representation of possible settlement of all the named legal issues before the courts. The various venues would not have stayed the legal proceedings without the joint representation or motion of the parties(litigants). So, the remote possibility of any or all of these cases being reactivated has never quite gone away, but will upon completion of the license agreement, payment(s) and final motions to vacate all the actions. Until such time each case in each venue is still alive on life support. Hopefully, we will have the IDCC v Samsung litigation funeral soon.
