If Samsung balks, then Judge Luckern is the next step.

As I replied to loophole, any respected opinion that there is a possibility that this case could go back to the ITC scares some nervous investors.

I thought that there was no way that this case would go back to the ITC. Now loophole raised the possibility however remote that it could happen.

In loophole second post, if I understood loophole correctly, he wrote that if this case goes back to the ITC, Samsung action could be the deciding factor against Samsung in any close call in claim construction by the judge.
