It's not a theory. On the date of the corp counsels release (Dec 5) a meeting, previously, had been scheduled for Dec 22. Propper notification deadlines have passed so the meeting will have to be held on a later date if at all.
Why don't you sue them.

Perhaps you would have rather the release say
"Mr. Frohling stated that the Company might have scheduled a Shareholders meeting for December 22, 2007, details to be announced"
that would be false because the company DID call a meeting.

Kenco, what is true for Lawyers is just as true for the Board's of publically owned companies, you can't PR false facts about current and past production or issue knowingly false projections about future production. Think about that as you defend BD and Lanza.
