Facts are left to a jury. The court instructs the jury what law they need to follow. You don’t realize it but you just argued for discovery to occur.

This a factual matter that can easily be established by NWBO if true.

At the MTD stage, NWBO does not have to establish the truth of any facts alleged, The Court must assume them to be true for purposes of the MTD.
At a later stage in the trial, NWBO will then need to prove the facts they allege, but not now!
