#82894 RE: SwissCheeseAccount #82893

My problem is if you look at the ECAP correspondences, The ECAP trustee told the ECAP holders if they want to out outside of the group to enforce the guarantee individually, they will have to seek their own counsel and file on their own. Something like that. I think that is what Cotton is doing.

I think cotton is supporting the ECAPS and while doing so taking a stab of unilaterally trying to enforce the guarantee. The question is, does point 6 and 7 only apply to him?

While I agree with all your points, maybe the reason that Cotton has filed now is due to a suspicion that the CTs Trustee is not really 'acting' as 'our trustee as a Fiduciary'...Unfortunately, that has what the 'Trust Business' has become it looks like...They 'collect' the money when they sign up the contracts 'as The Trustee' but never show up to enforce the Trust benefactors' (our) rights, when it matters...

I am very happy and really indebted to Cotton that he is filing this in support of this motion. At this time, my reading is similar as yours that once they enforce ECAPS rights and payments, automatically that would result in payments to ALL CT Holders BY LAW...But unfortunately, we have seen Laws being 'set aside' in various 'criminal acts' involving the 2008 Financial Crash cases.

I will wait to see what happens in the hearing... hopefully, something will be enforced towards CTs' payments by the Judge during this hearing...
