Yes Amarin can take the FDA to Court and sue them...Sovern Immunity does not protect them, they're a few ways around this.

I don't think it will go this far.

You can't sue a government agency for monetary damages, period, except for rare cases. If criminal activity is involved, you may be able to sue the individuals involved, but what you can recover is obviously limited. All fed employees are covered under a blanket protection rule that "they were just doing their jobs", even if they came to incorrect decisions - you might be able to overturn the decision in court (happens often in the contract area where multiple bids are received), but you generally cannot recover any potential lost revs, or money spent on proposals, certainly can't get punitive type damages.
