Are you saying that the patent they withdrew their opposition of its validity was a lawyer mistake and not a Nokia aquiessing. Since when does a lawyer not consult with his client and they agree?

Nokia just didn't want to have the court award more valid patents as they are still unlicensed and the more court awarded patents the weaker they get. It also would show that going to court with Nokia can indeed enrich your fee that you can collect from Nokia.

I think Nokia was caught in a bad situation when the late judge Pumphrey declared 1 patent as essential and valid, and Nokia said lets withdraw our challenge as we know what the verdict will be and its better to leave it has not awarded but unchallenged than it go in the record book as essential and awarded. IDCC would have loved that better than a withdrawl of the objection.
