TTE, I don't think that the Supreme Court should get involved here. I don't think this suit would be a good vehicle for them to clarify law. If you take away every assertion but one, it's cut and dry. Hikma recommended that their generic product be used to treat patients with HTG. That is our patent protected label. That is the definition of induced infringement. BBI is still correct that the Supreme Court could change the law.
