This doesn't really make sense. A. They likely have a contingency fee contract with the firm and B. The suit is in the hands of the lawyers, there literally isnt anything for the company to "focus" on.

Because you dont normally have to plead everything in a Complaint. There is strategy to pleading the bare minimum. You only must plead the elements in the light most favorable to the Plaintiff. Judge wanted more, and I am sure she will give it.

The Judge also is not making any assertions as to the merits of the case itself, just whether or not it has been pled properly.

You wouldn't amend until after the ORDER, which was entered yesterday. Judge Steins R&R from a month ago is not an actionable document. The Judge still could have denied their motion. Now starts the clock to amend the Complaint.

You must not have read the report and recommendations from Judge Stein. Maybe go check that out before posting nonsense. This happens all the time in civil litigation.

Judge Stein lays out exactly what we must change in the Amended Complaint. Defendant's renewed MTD should be dismissed pretty quickly after all is said and done.
