Those who think that howdy is an insider have not been here long enough to see some of his posts. He was negative on the stock a few years back. (I remember thinking that he was a short at some point in time based on some of his negative posts).
There will always be some conspiracy theorists around. I personally dont listen to much of what they have to say.

GC, a complete reading of the document indicates that Sony BMG is simply agreeing not to use Mediamax versions 3 and 5 as there is language in the document that specifically discusses what guidlines will be followed by BMG for the DRM that they will use in the next two years.
A close look at the actual "settlement agreement" is necessary before the above can be confirmed, but the above is a fair reading nonetheless.
Thank you for posting this document. I perused it and it appears to say what some of the longs here have contended for some time. Sony/BMG has left the door open to manufacture Cds with a newer version of Mediamax and has placed in line a framework for including copy protection on its CDs. This framework should become the standard used by everyone, if the Court approves the settlement and if BMG is successful in getting the State AGs to agree to the settlement also.(the document notes that a settlement in those cases was anticipated sometime soon.
All in all, I dont think that this is bad for SCMI, since BMG is fighting hard to keep the door open to use copy protection on its CDs.
This is what I had already read. On page 9 and other locations a "settlement agreement" is referenced. That document is what was generated as a result of the month long negotiations. That document should provide us with the exact scope of the agreement reached.
Anyone have the "settlement agreement"?

I read the settlement proposal filed with the District court in NY. There seemed to be an inconsistency in that in one part of the document it was mentioned that BMG would not make any more CDs with copy protection for two years and then in another part it was mentioned that BMG would do A, B and C when using copy protection. I could not reconcile the inconsistency but can only assume that the Exhibit to the document (the actual settlement agreement) which was the agremement between the parties (and not the motion which was filed with the court) will set forth what the parties agreed to in more detail.
Any one know a link to the exhibit?

someone else should do the math, but I thought that the revenue for MMXT was ~67K which is one half of the total revenue generated. So total revenue is ~134k which divided by .04 is roughly 32 million. Is this wrong? If not, I think that is a darn good number of CDs to be protected in one quarter.

I do not know how much they get per CD exactly but will assume that it is around .03 since MMXT showed income of about 105k last year and since the best information available is that about 10 million CDs were sold last year. (MMXT gets 40%)

Frankly, I dont care if you join the the U-RAH-RAH team as you put it. I just have a hard time understanding why you assume that lack of information on a topic necessarily translates to doom and gloom. I believe that the company has accomplished a lot over the years. If you fail to see the positives, that is your issue.

Since you so strongly believe that your money (I assume that you have been truthful in asserting that you are a shareholder) is “dead money” for months to come, would it not be best for you to take a break from monitoring “dead” activity for a while? Now, answering your question posted to Sting:
1. Kiosks. I have not seen any kiosks in my area. Do you have some in your neck of the woods? If so, do the CDs they produce come with copy protection? If so, which copy protection? Unless I hear otherwise from the company, I assume that they are working on the issue and that we will updated when there is any additional news. In the meantime, if you have information on this issue please enlighten the board.
2. The last I heard about CSN, II2 advised that he had spoken with them and that they were planning to manufacture the CDs. II2, if you have followed up with CSN, please let the board know so that everyone is current on the happenings. Duck, have you seen the CSN CDs out in the stores yet? Are they protected? Please let the board know any information that you have on the issue.
3. Anything above 50 million (for the year) and I will be happy. I have however not heard from the company regarding any updated figures. Frankly, I thought that their estimate was a little high given the slow speed with which matters were progressing. I think that the figures for the year can be better estimated when the numbers for the third quarter are out. If you have an idea as to what the numbers will be, please let the board know. I am sure that most everyone will be happy to hear your views on the issue.
4. As mentioned in the last company PR, the audit is being reviewed. Granted, I would have liked to know the identity of the entity that was reviewing the audit. Is it being reviewed by the individuals who prepared it? By an independent auditor? By the entity providing the fairness opinion? I am sure we will receive additional news on this shortly. Please let the board know if you any information on this.

Lastly, I think that the reason some on this board have a problem with your posts, is that you assume the worst when there is a lack of information on a particular topic. You claim that such assumptions are necessary given the track record of the company. While I will concede that the track record of the company is not great, you have to agree that based on information available, SCMI’s copy protection is the one used most in the US. We have contracts with numerous record labels and most importantly, verifiable income (gross not net).
Where will this baby take us? I don’t think that you know any more than any one else on this board.

The best way for SCMI to run off the nay sayers is to conduct its business in a professional manner and not allow them to have excuse after excuse to bash company.
While I dont agree with much of anything written by the likes of the people you mention, I think that you as an alleged representative of the company should do more to make sure that the company is meeting its obligations rather than argue for censurship.
The way I see it, if someone is saying something bad/negative about you, if its true fix it, if its not, dont worry about it.
You may well be concerned about future investors reading the posts of the nay sayers and refusing to invest in SCMI. SCMI has to fix this by meeting its business objectives.

Looked into it all. Setteled on a GoVideo DVD player (connected DVD) with a network card. Music, pictures and video on any TV in the house (I have a fairly elaborate system). The Ipod thing didnt work for me because it would have been impracticable to keep hooking up and unhooking the receivers in the house. The GoVideo Dvd player is hooked up to a receiver and can be accessed from any TV in the house via remote. Joe.
Dont own an ipod. Buy cds. put them on the puter. Puter connected to home stereo system. Keep Cds, if puter ever puters out, still have CD. Joe.
Sting, I am with you on this one. I dont know how effective or necessary it is to argue the point with the new entery self proclaimed longs that are obviously here to stir the pot (so to speack)
Let them say and do what they will. The reality of the situation is that if we have been taken (which I dont believe is the case) the money is long gone and no self respecting lawyer will touch this case without a large retainer. (by the way, any claim made against the company will surely be the demise of it (if they are crooks, they will run and hide; if legit, they will use up all money defending the suit)) Either way, its a no win proposition.

Your posts appear to be very similar to posts I used to read from someone on the RB STEH page. Did you post on that site? If so what name did you use?
In looking at the site you provided, I note that the product you refer to is made by a Korean company, which offices somewhere on an entirely different continent. Are you claiming that the fact that some korean company, with a product that was not updated since 2000 can lay claim to the name Mediamax in the US?
You attempt to scare the holders of this stock with what I consider fairly strained arguments against the company and the product. Why?

I think that the text when cut and pasted onto this site does not transfer the "advertisement" that was placed within the story but rather notes that an Advertisement was there in the original site where the information was copied from.

Agree. But please note that the article is from a British site and it would make sense that they would focus on the British company which provides protection. Reading the article, I dont even think that the author spoke with anyone at SCMI. The one mention of mediamax could have even come from First4's CEO who was attmepting to validate his position that copy protected CDs are gaining a foothold.
In short, I havnt lost faith yet.

I disagree. I think that the list was somewhere around 175 CDs at the end of the first quarter. Most of the first 150 CDs were promotions etc.
I think that the last 25-30 CDs have netted the 10 mil cds in the second quarter.

Where do you go to get the lowest commissions on penny stocks? I keep looking at the level II trades and note numerous trades of 5k shares of this company. at .03 that would amount to $150 spent along with at least a $10 commission(i once paid $100+ on a commission on this stock becuase my broker charged an additional fee for any shares above 2000). Who does that? The trades below 1000 are simply a joke, as they dont make any sense, but frankly, the 5000 blocks dont make any sense to me either at these numbers.

I dont recall much from my M&A classes, but I do believe the company is doing a reverse triangular merger. Reverse triangular mergers are usually used to allow a corporation to get rid of some unwanted and potential liability. The purpose is to first merge sunncomm into a third corp but leave some liabilities behind, then the new formed sub is absorbed completly into the surviving corp. I think that the language referred to in what you are quoting refers to the merger of sub and SCMI and not SCMI and MMXT. His is my best guess at what is going on, have not had time to read and analyze the various documents. Joe.
Macrovisions claim of 144 mil cds has been around for a number of years. I recall Kenco making that claim, and posting some article in support of the assertion more than 2 years ago. The CDs were released outside the US, and were the old Macrovision protection which had playability issues. If I recall the various posts correctly, a number of suits were filed against them for the CDs.
In short, I have not seen anything that would validate a claim that Macrovision has recently put out 145 mil cds with copy protection on it.
While we certainly have to worry about the competion, the information disseminated thus far (at lease the info I have seen) indicates that we are the market leader and the one to catch in this race. Joe.

I am not a securities lawyer, and have not read Kenco's post. (She spins everything and as such I dont put any value in her comments). I dont believe however that there is anything wrong with peter asking Merlyn to keep the email response confidential. First, the response is not "insider information" as I can only assume that you, I, and even Kenco can email peter with the same question and get the same response. We all would have access to the same information if we simply tried to get the info.
The problem with taking and cutting and pasting the information to everyone else is that people like Kenco, would then dissect, spin and utilize the information provided in a manner in which it was not intended to be. The naysayers, will scrutinize every and any statement to death if provided with an oppurtunity.
Dont get me wrong, I dont think that Peter can say Merlyn, the sky is white, Knowing that the sky is blue and then tell Merlyn to keep that from other investors. I dont think thats what is going on.
I think that Peter can in response to a specific question advanced say that the weather is "great" and expect that his quatification is not published to the public as it may be taken out of context, spun and dissected when the statement is simply a reply to an email from a shareholder which has not been approved by legal etc...
I expect that you can either choose to belive Merlyn and his general response, email Peter with identical questions (I hope and assume that you will get identical answers) or you can follow Kenco's lead and assume that Peter and the company are crooks who are trying to screw all investors out of money.

Sam, you have been here for sometime too. As I recall, your group of investors pulled out about a year or so ago, but you stayed on. Have you lost faith in the company? To me, this was a gamble when I first came in, and I figure this one will either get huge or go under in the next year or so. (I dont think that they can float it anymore (given the history) unless they turn a profit)

Just picked up a copy of the DMB CD. Have not had a chance to listen to it yet, but the wraper on the CD is clearly marked with information stating that the CD is copyprotected and that for supprot sunncomm.com should be contacted. The same information is on the CD itself in small print on the outher edge. Must say that it is nice to see that Sony BMG has gone to the trouble of including our name on the CD itself. Hopefully, this is a sign of good things to come from our partnership with them.

Frankly, it makes a lot of sense. Please note that SCMI started placing a lot of CDs on its list a few months ago after it announced that that BMG agreed to a full rollout. But then the CDs would taken off (per tnew for Rod Steward and Clay Aikin). It would make sense that after BMG agreed to use our protection on all its CDs, some of the its artists raised concerns regarding the copy protection being placed on their CDs fearing fan backlash.
Please remember that shortly after rumors of a full rollout, we started seeing advertisements from SCMI on Billboard, a move that must have been meant to get the artists familiar with our name, what we do as well as the benefits of our protection. Slow and steady inroads into the market is what was hoped for.
If the above is correct, I can only imagine that artists who have previously raised concerns about our product will slowely but surely change thier minds.

Dear Stehisit, I would think that with all the information that you have, your portfolio should include a large position in MVSN. This message board is one in which we discuss SCMI. While information about our competitors is welcome and should be posted, I dont see the value in you posting, reposting, restating, discussing, arguing, and rearguing your points on the competition over and over again. Has MVSN protected any Commercial CDs in the US? NO. I imagine that one of the reasons behind this is the playability issues that they have been dealing with. I would think that record companies are scared of using MVSN in the States because they KNOW that if they do, they will be sued left and right in every court in this state, and will end up paying millions in damages in jury trials across the land. SCMI has accomplished what MVSN with all its capital has been unable to do.

The list is still there, you just have to create ticket to get to the page. As noted by SUNNY however, the list is of no use unless someone makes a spreadsheet so that it can be tracked. The list has stayed at 156 for some time (I still count 156) but it appears as though CDs come off and then questionalbe items get added back on (Velvet Revolver Bonus Material). I sure hope that the company is not doing this intentionally to keep the number at 156.

Hello Everyone:
We have a new support page. The question and answers are encouraging. It appears as though they are providing support information for MM5. The Q&A still says that MediaMax discs are clearly labeled. There goes the theory of discs not being labeled.
The backdoor for ipod users is still there, which makes no sense to me if secureburn is implemented (the support page says secureburn is active on MM5.
Lots of references to audio and vidoe, which is encouraging. I also noted that they mention that they are already working on the next version on the property.
