GC, a complete reading of the document indicates that Sony BMG is simply agreeing not to use Mediamax versions 3 and 5 as there is language in the document that specifically discusses what guidlines will be followed by BMG for the DRM that they will use in the next two years.

A close look at the actual "settlement agreement" is necessary before the above can be confirmed, but the above is a fair reading nonetheless.
