Hey, anyone here have a Pacer account (Public Access to Court Electronic Reports). If you do, login and do a search on GeoBio and see what you find, it is quite intriguing. If you don't you can sign up for free (although searches cost $0.08 per page) www.pacer.gov.
If you do a search on GeoBio, you will find a single case. Click on that and you will see (cliff notes) it is ST suiing several MM's the company and certain individuals. The case was filed Dec 20th and Dismissed Jan 19th (by ST). It basically shows admission on S/T's part of shorting 19m shares. They were trying to sue the other MM's as they claimed they should have known better than to accept the orders from S/T based on the O/S and the price.
It also mentions a forced by in by one of those MM's if S/T does not deliver the certs.
This is very sumarized, you should go read it for yourselves, it is very damning. S/T may not have covered yet, but if they don't soon, the MM's will do it for them.

Now that it is out there I can disclose what I have known. ST is seeking relief due to MMs requesting forced buyins to cover the mess that ST caused. MMs are requesting that ST cover over 19 MILLION SHARES or they will take action. This case clearly states that ST screwed up! Read the 11 page document and you will see for yourself. This case was dismissed on 1/20/2011 by scottrade because legal action was threatened by MMs. ST has agreed to take care of the mms requests within 35 days of dismissal. Can you say SHORT SQUEEZE!!!!!

$9.24M annual revenue guidance from 9/23/2010 Presentation to Investors.
Additional deals are being pursued that could quickly double this figure.
Share structure is very low: float less than 14M shares, Market cap less than $4M.
There is no dilution and won't be, as cable acquisitions are seller-financed.
2 TV licenses were acquired out of bankruptcy for only $45,000: now providing local feeds of Azteca and Mexicanal spanish television.
Plans to develop a Small Cap Financial Network, which would cover small cap stocks only (something missing from the likes of CNBC, Fox Business and Bloomberg) - this channel will eventually go national. WNRC is working closing with Charter Communications on this venture.
Outside the TV stations, WNRC already has cable system revenue of $300,000 per month.
Chart is setting up for a breakout, having closed above .10 for the first time in years on Friday.
IHUB Boardmarks (aka Followers) have risen from 105 to 135 in the past 2 weeks.
The company is also in the process of providing Pink Sheets the proper documentation to remove the Stop Sign warning.
Many believe, once the company grows enough, it could become a buyout target. This probably won't happen for a couple years, but could be well worth the wait.
I'm sure there are some other minor points I'm missing, but these are the major ones.

New FINRA rule 4320 which goes into effect 2/28/11 should help to clean some of this up and this post by Dr Jim DeCosta touches on why the short sale reporting is meaningless at the moment imho:
There’s 3 new laws gaining attention in the NSS market reform arena: FINRA 4320 goes into effect on 2/28/11. It mandates 13 day buy-ins for open delivery failures FINALLY applying to shares of non-reporting corporations. FINRA 2010-043, also starting on 2/28/11 reinstates the “short sale exempt” (SSE) marking requirements for trade reporting and the OATS system. Those MMs accessing the bona fide MM exemption from executing pre-borrows or “locates” before admittedly naked short sales must now FORMALLY acknowledge the accessing of that universally-abused exemption. Being that these trades are theoretically being made to “inject liquidity” then the excuse to hide the related trade data from the public’s eyes goes out the window. You can’t have it both ways and claim the bona fide MM exemption and later claim that the related trade data needs to be kept secret because it might reveal a “proprietary trading strategy”.
Truly bona fide MMs that are able to legally access that universally-abused exemption cover their naked short position on the next downtick after their short sale when buy side liquidity is in need of being ejected as share prices fall. The 3rd new rule which is in effect now states that the offers and bids that MMs post must be of approximately the same size. No longer can the offers be of 1 million shares and the offsetting bid good for the minimum 5,000 shares.
The verbiage in 4320 is especially well done as it FINALLY puts the clearing firms that aid and abet this crime wave on the spot. With the FFETF, which is made up of 25 different agencies, now on the scene the transparency has increased markedly. You can imagine how critical the lack of transparency is to a crime involving selling nonexistent securities and then refusing to ever deliver that which you sold AFTER being allowed access to the funds of the investor being defrauded.

DEC 2010 .. can be split into 2 .. b4 12/10 & 12/13 and after
notice while volume is picking up b4 12/10 that finra's daily
reg sho data runs in the 40% to 60% range
when HHWW's *VOLUME* is deliberately blown out .. reg sho shows
20+ percent range for both days (there are no coincidences when
stock is controlled) and it's not retail usually known for CONTROLLING STOCK
then notice as calls are made and info confirmed by the TA/MGMT
we see something rather telling imo .. there are 13 days remaining
in DEC 2010 .. post *volume blow out* .. (12/14 to 12/31)
notice volume is the highest on 12/14 and lowest on 12/31 by a
significant amount but notice .. 8 of those days daily reg sho
shows 30%+ or more .. 4 of the remaining 5 days reg sho shows
20% + ... i noticed the *circular trading* .. well over a week ago
but since it was a holiday week .. hard to know for sure
what follow thru would show
check out the first week of jan 2011 stats .. to see HHWW's volume
consistently below 1M .. one has to go back to mid november 2010
imo it's pretty clear based on historical when *whichever*
entities planned and executed the assault against HHWW's stock
(and the co.) got underway .. which is why my caveats remain
volume and percentages matter but not necessarily for obvious
reasons .. finra's daily reg sho shows imo *legit* buying vs.
*circular* trading .. or swapping .. it looks to me as if we
are seeing some covering done friday (again resets are constantly
being done by those who seek to control stocks that are newly
public via a r/m) .. anyhow it will be telling to see what the
legal short info (also put out by finra) for the 2nd half of DEC
has to show
that is due next week on the 11th after com/close of market

Thanks so much, actually I am looking for a quality stock to invest in - one that was doing well early last year but maybe had a bad 4th quarter and experienced a tax loss sell off without any real fundamental changes in the company that would impede their ability to be successful in 2011. I think there are some good opportunities in this area if I can just find them - thanks for the suggestions - I will check them out before the open on Monday!

for the past 6 months or so
it sure seems like they can do well in
2011 .. as in double their pps .. watching
their SS and short data .. one thing if one
trades .. they have a very noticeable channel
in play *created* by the MMs' :0 which makes
it rather easy .. to trade .. :)

not to pump but a couple of others one might want

imo do a r/s and take co. private .. even tho' current

Defensive Actions For Companies And Share Holders
When naked short sellers strike and manipulate your stock price and attack your company, the most
important step is to decide to do something quickly and defend your interests - avoid doing nothing.
1. Stand up and Defend Your Reputation, Employees, Customers, Securities and Investors
It seems only too logical that when you are attacked, that you defend yourself. Unfortunately, the vast
majority of executives and their board of directors decide to do nothing. Perhaps it is because they do not
fully understand how the markets work and how the manipulators can do what they do - that's our hunch.
Most executives are honest hard working people and think that if they just run their business correctly, that
the financial results will speak for themselves and that the securities markets will respond accordingly.
Even the SEC and their staff don't seem to understand that by being complacent, they are allowing the
short sellers to run amok. Jim Cramer put it fairly well in this short article. Since the regulators won't help
you, you need to help yourself.
Those who have targeted you and attack your shares love a complacent attitude, because it makes it
easier for them to tear down their targets, without resistance and thus succeed in reaching their goal. It's
also true that these manipulators usually know far more about the securities markets than the executives
of the companies they are attacking. The manipulators also have the advantage in that they know what
they intend to do in advance, while the executives do not know what's coming.
The executives, because they usually do not fully understand these manipulation schemes in the
securities markets do not take the threat to their companies as seriously as they should. Not only can
rumors and false or misleading reports cause great damage to their reputations and increase the cost and
access to capital, but they can overwhelme buyers by manipulating and creating selling pressure with the
leverage that short sellers can bring to bear, especially via settlement failures.
Not only are the funds that are brought to bear in attacks usually very large, oftentimes even larger than
the market cap of the attacked issuers themselves, but they can get away with violating rules that are in
place to protect investors and issuers because they know certain important ones will not be enforced. Most
important are the violations to the settlement rules. By violating settlement rules and creating
settlement failures, the manipulators can force the price downward at will. Regulators simply will not
enforce these rules. That's just the way it is.
See the section in this Website as to the rules on the books that are not being enforced. The most
important thing to know is that the attackers can sell unlimited amounts of your securities without delivering
them or having them on hand, borrowed or located. While this is happening, there is almost nothing you
can do to stop it. But you can respond after the attacks have started.
It seems to us that those issuers that do nothing are almost always plowed under by the manipulators or
are oftentimes permanently damaged. Those that prominently stand up and at least try to do something
seem to have a better chance. The most vocal of the issuers under obvious attack, Overstock.com, has
been able to claw its way back and stabilize its share price. We suggest issuers that are under attack by
illegal short sellers, that is any issuers that are on the REG SHO threshold list or otherwise have evidence
that their shares are being manipulated by short sellers, learn from the past actions of other issuers who
have defended themselves and been through this already.
So what can issuers do? You can file a lawsuit and go straight to number #6 below, and also do one or
several of the following:
2. Publicly Expose The Price Manipulation
The best thing you can do as soon as possible, is to bring this out into the public light and publicly expose
and explain what is really happening. Otherwise the short sellers and their agents will frame the mystifying
market activity in a way that is beneficial to them and harmful to you. This is a battle for your survival,
make no mistake. Do not underestimate the resources, craftiness, patience and determination that will be
deployed against you. They will be considerable.
Bringing the battle out into the public light makes things more difficult for the illegal manipulators for
several reasons and forces them to expend more resources. And not only can you pacify customers,
employees and investors by dragging this out into the open, but you show you are aware of the issue and
are acting to protect them.
PR Release
A first response may be a simple PR that says that you have become aware that there are "fails to deliver"
and possibly "fails to receive" securities distorting the market in your securities harming you, your
employees and investors and that you will be looking into the matter and taking appropriate action to clear
out the market in your securities of these illegal and harmful securities.
Depending on how detailed you want your response to be, you can end it there or continue by stating that
you will do all possible to ensure that, in the market for your securities, the delivery of securities sold
occurs per the mandatory settlement date delivery requirement in the settlement cycle rule, 15c6-1 and
that you will do all possible to ensure that state corporate and state securities laws are not violated. You
can state that recent activity and data indicate that the market in your securities is being distorted and
manipulated by violating federal and/or state laws. Do not use the term T+3.
3. File Lawsuits Against Those Releasing False Reports
If there are any false reports being released about your company, which you think is deliberate and
harmful to you, do not hesitate to sue those responsible immediately. The sources can be analysts,
brokerage firms and TV or print journalists. Check with legal counsel on how to proceed. If you doubt that
journalists and analysts are in cahoots with illegal short sellers, please see the names named at
Deepcapture.com in the articles written there showing the hard proof and connections. Please also see
the Fairfax lawsuit, that reads more like a novel and also the Overstock lawsuit against an analyst firm
releasing false information in cahoots with a hedge fund - Rocker Partners.
4. File Complaints With Regulators
File official complaints with the SEC, FINRA, the CBOE (if options are traded on your security) and
whatever exchange SRO your shares trade on, signaling that the settlement date delivery
requirement in 15c6-1 is being violated in the market of your securities by someone and ask that the
violators be identified and punished and 15c6-1 be enforced. Don't take the explanation that REG SHO
regulates "fails", when 15c6-1 already makes them all illegal. Settlement failures are never legal. In
addition to violating rule 15c6-1, mention that as a consequence of violating the settlement rule 15c6-1,
the rules below are also being violated:
1. Section 9 of the Securities Exchange Act of 1934, prohibition on appearance of trades
2. SEC Rule 15c3-3, the customer protection rule
3. Section 17A of the 1934 SEA, accurate settlement and clearing
4. Section 6(b)(5) of the Securities Exchange Act of 1934, prohibition on discrimination against investors
and issuers
5. UCC 8-501 Securities Accounts
Keep riding these federal authorities as they'll delay and make false promises to you. Later it will be shown
that you exhausted your options through the authorities. If it takes longer than they promise to do and
finish an investigation or otherwise lie to you, call the Inspector General of the SEC, the Department of
Justice and your political representatives about possible illegal personal behaviour that is harming you and
the failures to enforce settlement laws, allowing the manipulation of securities.
You should also contact and file a complaint with your state securities regulator and NASAA, claiming that
state securities laws are being violated regarding the manipulation, delivery and misleading statements,
etc....regarding your securities. Cite the violation to UCC section 8-501 (see UCC analysis),
5. Demand Securities in Certificate Form
Skip this step and go to the next if you do not have confidence that the majority of your shareholders can
act in a concerted and coordinated fashion.
Do not even try to smoke out the illegal short sellers with things like paying out cash or non cash
dividends, trying to register all beneficial owners, etc.....why? Because those exercises, while interesting
and may yield some useful information, generally is a waste of resources and time.
One strategy that could be very effective is a so called certificate pull. That is if all or at least a large
percentage of investors in your security simultaneously demand that the securities you have issued and
that they have purchased through brokers be delivered to them in physical form by their brokers. This
should only be considered if you are confident that you can communicate with a very large percentage of
the share holders and that all are on the same page and that you can all act as one to the end.
This is mandatory, because there will be several steps that all will have to cooperate with to make this
strategy effective. All share holders will need to act as one. When it becomes obvious that the brokers can
not deliver the physical certificates in the numbers that they should to all share holders, a lawsuit in state
court needs to be filed by those not receiving physical certificates. The others who did receive physical
certificates would need to disclose to the plaintiffs the numbers of certificates they did receive, so an
aggregate tally can be kept and shown as proof. If your security is a pink sheet or otherwise a non NMS
security, proving wrongdoing is even easier as none of these types of securities are permitted to be lent
out per REG T of the FED. The short interest should be zero and there should not be any "fails to receive"
or "securities entitlements" reflecting unsettled securities or IOUs of any kind.

The brokers of the above, who do not or can not deliver the securities in physical form
Cause of Action
The violation of state laws and the UCC that control the form of securities and that confer on all investors
the right to demand their securities in physical form. Brokers can not deny this right, even if
customer/brokerage account agreement explicitly say they are not entitled to physical certificates.
We suggest that the number of plaintiffs be less than class action size in order to allow the lawsuit to
remain in state court, as all class actions regarding securities are automatically moved to federal courts. A
lawsuit filed to compel delivery of physical certificates should be filed in conjunction with a second separate
lawsuit in state court that includes you the issuer as plaintiff alleging violations to state laws and seeking
damages. See below.
But you may want to consider and discuss with legal counsel if you want to include all damaged
shareholders in the lawsuits, making this a class action lawsuit after all. The disadvantage is that the
process is slower and gets heard in federal court, even if the causes of action are state laws. This decision
should be a strategic one.
6. Strongly Recommended Lawsuit in State Court
Any issuer or share holder groups can go directly to this step as a first action of defense and skip the
others above. Ultimately, this fourth and last step is mandatory if you really wish to wipe out the "fails" and
price manipulation from the market in your securities. It is very powerful and the legal trail has already
been blazed for you by others. Please feel free to email us to discuss, coordinate and assist you in any of
this.
What not to do
As background, it is important to understand, that suing the SEC and SROs is a waste of time, because
they have legal immunity to a great extent and that is not a promising path. However, state laws have just
as strong an effect on securities and in protecting investors and issuers as the federal laws and rules do.
The U.S. Congress explicitly left certain areas of securities regulation to the states. Since on the federal
level, the SEC and SROs are apparently deliberately not enforcing federal laws and rules and are coming
to the aid of defendants in federal lawsuits via testimony and Amicus Briefs, we should side step that arena
entirely and apply state laws to the violators.
What to do - sue the broker-dealers
Novastar share holders and Overstock.com the corporation, have blazed the trail already, creating
case law along the way by suing the prime brokers. All you really have to do is file a copy cat lawsuit in
California state court to get you to discovery. The Novastar shareholders filed their case first in 2006 and
Overstock.com followed a bit later with a basically identical lawsuit. Both have now been consolidated into
one as the nature, course of action and the defendants are identical in both cases. These lawsuits were
filed in California state court with California state laws as causes of action. A copy of the original filing can

The Defendants moved the case to federal courts, but were not successful in keeping it there as the
federal court remanded the case back to the California state court : Case back to Ca State Court. The
defendants then petitioned the California Supreme court, which also ruled against them in denying to
review the case: Novastar Answer to Petition Request. The petition for review, that the defendants
requested, was denied by the California Supreme Court on 4/30/2008, paving the way for discovery to
begin, which is now ongoing. As of 4/17/2009 the claims under Code § 25400 have survived all challenges
by the defendants.
If the cases are filed in California, you can claim violations of the:
California Corporations Code § 25400, and (2) unfair business practices in violation of California Business
& Professions Code § 17200 and §17500.
In addition, you can claim violations to the California Blue Sky laws governing Delivery § 8301, those
governing securities accounts § 8501, obtaining and maintaining the contracted securities § 8504, false
statements § 25401 and those addressing manipulation § 25216

Are ZAGG Short Sellers Safeguarding their Bearish Bets with Calls? Schaeffers Investment Research "Market Commentary"

Northland Securities today lifted its price target on protective-covering manufacturer ZAGG Inc. ( ZAGG ) to $11 from $10 , according to Briefing.com. The new target is more in line with the stock's consensus 12-month price target of $11.50 , as calculated by Thomson Reuters , which represents a relatively steep premium of 56% to ZAGG's closing price of $7.37 on Monday.
In the same vein, it appears the options arena may be growing more optimistic toward ZAGG , too. The stock currently boasts a 10-day call/put volume ratio of 3.59 on the International Securities Exchange (ISE), implying that speculators have bought to open almost four ZAGG calls for every put during the past couple of weeks. What's more, this ratio registers in the 70th annual percentile, suggesting that options players on the ISE have rarely initiated bullish bets over bearish at a faster pace during the past 52 weeks.
However, the recent affinity for long calls could be related to hedging activity by the shorts. Short interest on the equity advanced by 57.6% during the past month, and now accounts for 21.8% of the stock's total available float. In fact, at the security's average pace of trading, it would take roughly a week to repurchase all of these pessimistic positions. In any event, this simultaneous influx in short interest and call buying could indicate that short sellers are protecting their bearish bets with bullishly biased options on ZAGG .
At last check, the shares of ZAGG have added 1.9% to flirt with the $7.50 level. Nevertheless, the stock's upward momentum has run into a speed bump in the form of ZAGG's 10-day moving average, hovering just overhead in the $7.80 neighborhood.

I hope you are having a good Holiday, my family's out of town so I used the time to teach my computer a new trick...
I imported all of the short sale data to a database and produced the following report.
I know you are aware of what is going on, but I thought it would be nice to show folks the "year in review" so to speak.

(my bolding/red & blue emphasized .. remember YTD *record* volume
on EXPH done first on 6/2 re: form d *debacle* .. then the
day after the SM .. pr out that AM .. 9/16 .. then on 11/29
the *frenzy* on the AS increase out of NV SOS that wouldn't
be *ISSUED* by the TA till 12/8/2010 ... then *again* on 12/10
with the last *frenzy* done on 12/22/2010
notice b4 july 2010 .. the *pattern* in play on EXPH was
already well established .. for ease of *viewing* i just
focused on days where reg sho data shows 60 percent +
also
notice the time of month that pattern played out in the
first half of the year .. and then notice what comes to
pass in july .. then into august as kendrick is pr'd re: BOD
and don't forget to review the bear raid done on those 6M
shares .. two days b4 the SM (9/15/10) those shares were
critical re: *control* since the status of fins/forms/ceo
*wasn't* known b4 the pr out PM on 9/16
and then lastly notice the *concentration* of the 60+ percentages
as november comes into play ~ EXPH is now showing higher and
higher reg sho percentages consistently
and for any new eyes .. remember the basics here
mgmt didn't raise the AS on EXPH till mid march 2010
(first time in the 3+ years as a public co. and while
ETC couldn't be spun off due to a share discrepancy
all of known mgmt .. jd and glenn hold *common* shares
meaning they too share the pain or gain re: EXPH's pps)

imo of the approximately 10 OTC co.s i've followed
over the years .. all are *victims* of abusive NSS
and the suspects imo are varied .. but i expect to
see hedgies implicated as well as MMs' who've *effected*
the trades as well as prime broker dealers .. suspect the
system needs to literally collapse to force *change*
i've posted on my NSS board that every co. that comes
public should now be electronically tagged so that there
can be no more bs re: hard locates .. let alone stock
*actually* being delivered b4 being used again and again
and again .. just adding to the mess and total bs figures
those who collude pass onto both finra and the sec who
apparently find it completely *normal* that a company
that has been public for 3 yrs with FTDs shown every
quarter .. would magically *cease* to show ANY over X
no of mos and 7 BILLION shares .. er .. traded
then every co. that is traded should be retrofitted
re: electronically tagged stock within a specific time frame
no commentary .. no BS .. and if it means they have to *re*
grandfather certain co.s with a few BILLION shares NSS
(and imo they absolutely exist on the OTC) then so be it
but this crap needs to be dealt with ASAP .. it's getting
beyond absurd
btw .. there is zero reason for MMs' to exist in this day
and age .. due to technology available and of course hedgies
need to disclose/disclaim all *data* as well including *hires*
it's very clear to me from over 3 years of watching rt l2
that manipulation is endemic across the board

Ngensolutions LLC
KRRI is now being carried on the local cable system in Reno, Nevada. It is on the expanded basic and digital line-up, channel 238. It is the local affiliate for Azteca America a Spanish language television network.
KRRI will begin to generate advertising revenue at the end of the month when the cable company begins inserting commercials at Ngensolutions' location. The revenue to Ngensolutions will come from a split of ad sales with the cable company.
KRRI has launched local programming for the Reno area. The first being developed is a children show featuring local elementary students. The second is a soccer league where players discuss upcoming games and show past video footage.
Ngensolutions has signed a retail sales agreement with the local cable company. The Company can generate as much as $150 from new cable subscribers. By providing local programming, the Company will drive additional cable customers, interested in viewing these programs exclusively on Azteca and cable.
Ngensolutions has signed an affiliation agreement with Mexicanal, a regional Mexican programming service provider. Under the agreement Mexicanal will provide marketing capital to Ngensolutions.
Ngensolutions has moved the KXTO-AM 1550 Radio Station to its new studio.
Ngensolutions has signed an agreement to operate a "Smooth Jazz" station in Reno. The Company will sell ad space and have an option to purchase the license.
Ngensolutions is pleased to announce its new programming director, Steve Halliwell. Steve brings over 25 years experience in the production of television programming. He has worked for affiliates of Fox and other networks.
Ngensolutions has hired on-air television and radio personalities.
Ngensolutions anticipates advertising revenue from cable, radio and broadcast to cover all its operating costs.
Ngensolutions hosted an "Open House" of its television studio in Reno, Nevada, on November 12th. Executives from Azteca America were in attendance. Other local dignitaries also enjoyed the festivities.
Ngensolutions is a media company with interests in radio and television properties located in Reno, Nevada. Ngensolutions is the owner-operator of KRRI-LP Channel 25 and KELM-LP Channel 43 television stations. Ngensolutions also owns an interest in KXTO-AM 1550 Radio, which is broadcasting and generating revenue.
Satview Broadband Ltd.
Satview has continued its operations in: Topaz Lake, NV; Jackpot, NV; Wells, NV; Fillmore, UT and Delta, UT. Operations continue to be profitable.
Satview expects to close with Baja at the end of the year. This cable system will immediately generate revenue for Satview.
Satview will continue to explore for additional acquisitions.
Satview has been in operations for nine years and is headquartered in Reno, Nevada. Satview holds franchise systems in markets in Nevada and Utah. It provides cable television and is an Internet provider.

my point is basic .. system sux due to gross and
egregious manipulation and imo without a doubt
collusion with some in the very agencies charged
with regulatory *awareness*
the point that is missed *completely* is that it
doesn't matter where a co.s' stock is *traded*
this pattern shows clearly the crap in play .. played
out daily/weekly/monthly and in some cases *years*
it is what it is .. folks can use it if they so choose

So what exactly does this data tell you?
Short% --- Doesn't that also represent all trades executed by long sellers who have had their trades routed thru a market maker? Not really a short but a long sale.
how does YOUR short% match up with FINRA's Short interest report for the company? Last I looked, no short interest and no FTD's. hmmmmmmmm

remember .. literally 14 days later .. BSPM would be added
to the reg sho threshold on 12/14/2010 and *remain*
link back for historical volume and it gets even clearer
and why one of the things i look for is *volume* shown at
the eom and early into the next month .. but notice even
with all that *volume* showing pps stays essentially stagnant
there is a reason for that and it's why i like to do this analysis
over (at a minimum) a month to 3 ~
i call this pattern (with little by way of pps movement) the stall
tactic .. as in wearing down investors .. cause they *SEE* *volume*
but no real pps increase .. and again unless someone is actually
tracking every individual trade .. all one sees is *volume* and
little by way of corresponding *interest* reflected in the PPS
how very CONvenient

legal short info coming out of finra/sec
really is .. and realize when a tout for the hedgies
asks for a link .. explain ~ why bother since the details
never fit the facts .. so there is no point in providing them
let's get the sequence correct since i'm very aware of
FTDs' *magically* disappearing elsewhere (for example on
EXPH .. a company that showed FTD's for every qtr as a pubco
has now had over 7 BILLION shares *traded* since the last
FTD was *shown* back in JULY 2009 .. stunning how corrupt
the system is and for many co.s literally useless
i should also mention that this stock is a naz based stock
but again the patterns are what matters vs. what is *shown*
the system is supposed to work in a relatively straight
forward manner .. even with info conveniently being always
in arrears in regards to this data by the very entities charged
with regulatory compliance
stocks get traded .. settlement takes place .. there is
a discrepancy .. FTD shows and is noted .. too many *show*
and stock hits threshold
like a few other stocks i'm watching .. BSPM just
graduated to the reg sho threshold list LINK
that event kicked in on tuesday 12/14 and continues thru
the com (close of market) yesterday

Short Sale Volume Reporting’s are deceiving.
I spoke to FINRA today and found out some very interesting things that until now I did not fully understand. I knew there was something wrong with this transparency of information but was not 100% sure what it was. I think I have my answer and it was enlightening.
I was first directed to the Notice to Members memo dated 9/29/2009

The individual I spoke with wanted to make clear that to maintain proper trade volume reporting accuracy, a trade with multiple legs in the trade would only be reported once in the volume reports. The example given would be.
Investor A is long 100 shares and wants to sell. They enter the order through their broker that is routed to a market maker. That market maker will go out and sell the stock into the market before they have bought the stock from you/your broker to close out their account. They do not take possession first as there is no guarantee they can sell the order into the market. By this Notice, the actual sale INTO the market is a short sale because the market maker sold the stock into the market BEFORE they had purchased the stock from you. It is a technicality since they know there position will be closed out minutes later when they go in and buy your shares. To avoid doubling up on trade volume and distorting the picture, only the sale into the market (consolidated tape) is recorded and not the second leg which was the sale transaction between seller and market maker.
So, this is why the short sale volume is high but also why the FTD’s and bi-Monthly short interest reports are not showing any indications of this volume. The short isn’t really a short it is the execution of a long sale by a market maker. The key language in the FINRA notice is this:

Consolidated tape is the open market where the transaction between seller and market maker is not done at the consolidated tape. That call this the media transaction.
Now for those wondering about Bona-Fide Market Making, I found out it can still be done but not electronically. The 15c-211 applies to electronic trade. Market Makers can continue to execute Bona-Fide Market making through phonic transactions but those sales made would be reported in the short interest reports bi-monthly and if not closed out will be reported as FTD’s in the system like any other trade failure.
Hope this helps at least clear up the high short interest volume reports seen. The reason the number is not 100% is because not all orders are routed thru independent market makers.
Since there is so much discussion and confusion on this I would request this be added as a sticky note since it clears up the confusions here.

viewing this info over days/weeks and months and in one

the time to cross reference volume/t trades that bypass
finra's daily reg sho (of substance like are done on SIAF can
totally *mess* with the percentages) and then reg sho *daily* itself
the patterns do indeed become crystal clear
i've already done the info on 3 co.s ~ EXPH/NENE/HHWW
i'm currently working on the stats for BSPM
and why would i be doing that? .. well riddle me this
why do FTD's *magically* cease on BSPM on 11/10/2010?
and the twice monthly *short* info shows *minor* amounts
with the *last* info shown/known on 11/30/10

like every other stock i've done .. the patters of BS are
crystal clear .. but it does make me wonder what the hell
the SEC is actually waiting on ~

about what patterns are shown via reg sho's
daily info on any co. .. not *specific* to eigh
and that link can't be *posted* without violating
*aspects* ~ but i did one to *patchman* just this am
i've done them on a few co.s *publicly* .. the
patterns are remarkable by what is shown and that
info can be done on any co. including eigh (like
all other DD .. it's time intensive but telling :)..)
as for the patterns shown on any co./eigh
i personally look for changes of what is done over
weeks and months percentage wise out of finra's daily
reg sho .. say for example when a stock shows *short*
volume (finra's terminology) over a month in the 60/70
percent range .. that then *morphs* to 80/90 percent
the following month .. that kind of pattern
my caveat has never changed >> volume and percentages .. matter

but i'm very familiar with legit co.s getting
*attacked* .. i'm not commenting on eigh specifically
since the only DD i've done is to observe some

it's very clear that *volume* shows and when .. but what
is also equally clear to me .. is what reg sho shows and
why .. sometime last week a decision was made by X entity
to *run* this stock and then short it back down .. REMEMBER $$$$$
is made both ways via *MANIPULATION* which of course is a felony
what i refute in total is that Horiyoshi (a company that is
fully filing and following the sec's dictates to a T) was
involved .. monday's DD with the TA and corp counsel prove it
for anyone with interest to call and do their own DD ~
and based on what i'm showing via reg sho whichever entitie/s
colluded with citron can be easily tracked just based on when HHWW's *volume* BLOWS OUT :0
to say nothing of when those *large* blocks of shares (that bypass
reg sho) break the *pattern* shown .. :)

This Is something to look into ! I found this doing my DD.
Market Makers are able to short stock, this can lead to price manipulation. You may not know it but some of this is naked short selling or even legal short selling using your own shares against you which can lower the stock value and adversly affect your investment, Market Makers do this by "borrowing" shares to cover their shorts, your shares possibly. The only place Market Makers can borrow shares from is other Market Makers or brokers and guess what brokers have plenty of - thats right, their clients shares - your shares. Why would you want your shares loaned out to use against you and adversly affect your investment while the Market Makers use those shares to make money for free off of what you paid for? This is common in penny stocks (although naked short selling is illegal it still happens frequently in penny land). The solution may be to make sure your own shares are not used against you is to tell your broker in writing to not do this, it is your perfect right to do as they are your shares. If all share holders would do this the supply of free shares available to Market Makers for shorting would dry up, then they would be forced to actually buy their shares and do a lot less shorting and as a result a lot less price manipulation. A lot of brokers will tell you this is not a problem and they do not do this, however, behind the scenes they will do this and without specific denial of permission in writing from you they can legally loan your shares to Market Makers. Other brokers have similar if not exact procedures, Schwab is similar. Its recommended that you follow the advice above with your own broker. If you contact them they may try to lead you away from doing this, do not let them do that, demand their exact procedures for doing this and put your request in writing to them and in line with their procedures. I would recommend certified mail so you will get a return receipt - do not email or fax or transmit electronically - do an actual physical letter to them and go to the post office and mail it in an actual envelope as certified mail. Make sure you sign it and are very specific as to not granting permission for your shares to be loaned, also make sure you meet any time lines or requirements outlined in the broker instructions. If you agreed to let your shares be loaned when you opened your account this letter will override that and remove that permission. You do remember snail mail don't you :)
