It is an unusual situation, as the SEC doesn't seem to have specific protocol to address the misuse of EDGAR by non-registrants.

It might fall under the Delinquent Filer Program:

The SEC gives both an E-mail address and a phone number to make reports. Other direct contacts at Enforcement might work, too.

If/When the SEC did something, in this type of situation, what type of penalty do they usually give a company? Can the company, say "my bad, its only been a few filings, done in error" and then get a slap on the wrist or a lot worse? Thanks.
