Nokia Pacer filing:
It seems from Nokia's filing that Nokia is arguing that IDCC should be required to prove that its patents are essential to 3G in the Deleware case. In other words, they are trying to shift all burden of proof in this case to IDCC. If I remember correctly, the judge already threw out this part of the case. It seems as though Nokia is trying to resurrect the patent issues again through its Lanham complaint.
Furthermore, as I understand it, Nokia's original complaint was that because of IDCC's patent claims, Nokia somehow had been economically damaged by IDCC. But now they don't think that they should have to prove that they have been damaged. Just where did Nokia's attorneys get their law degrees from?
This is getting beyond the point of being ridiculous!!
