WE will soon find out. My main reason for interpreting the order the way i am is that the other way it would mean that both parties would have to agree on a date which is highly unlikely. Also it would also mean that a date could be set for any time in the future, weeks months or even a year. This judge always specifies a time. 15 days, 10 days etc. At any rate Dec 1st is right around the corner. This case is taxing a lot of people's brains. But its all entertaining.

i`m not a native english speaker, but:

"If the parties are unable to come to an agreement, the Court FURTHER ORDERS the parties to schedule a settlement conference with the United States Magistrate Judge assigned to this case no later than December 1, 2013."

is very exact.

i write the important pieces again:

" .... the Court FURTHER ORDERS the parties
to schedule a settlement conference
with the United States Magistrate Judge assigned to this case
no later than December 1, 2013."

first, the court orders the parties (no wiggle room, stupid)
secind, to schedule a settlement conference (again, no wiggle room, they have to schedule it)
third, they have to invite the magistrate
fourth, and all before the december 1 (yep, the december 1, lol).

that means, the judge wants to know the results of the conference at the evening of the december the 1.

the results and not the date :-))
