I think secureit is correct.
"If the parties are unable to come to an agreement, the Court FURTHER ORDERS the parties to schedule a settlement conference with the United States Magistrate Judge assigned to this case no later than December 1, 2013."
Step by step....."If the parties are unable to come to an agreement (by Dec 1,2013) .....in other words they did not get together to discuss an agreement, now they are ordered to SCHEDULE a definite date to have a settlement conference.
It does not say that they have to have an AGREEMENT by Dec 1,2013.
The judge wants a definite written in stone date when they will have the conference, no more, well when we get around to it.
It clearly says, if no agreement by Dec 1,2013......NOW you have to go to the judge with a schedule of exactly when you are going to sit down and talk. And you have to come with your schedule no later than Dec. 1,2013
That's the way I am reading it.
