Blue Tower: The responsibility is always at the top. Look at what NOKIA does. They fling $#it at the wall, hoping some of it will stick.
IDC should have done the same. Throw all the $#it at Nokia, ZTE, Huawei, and Samsung and see what sticks. At least you have opened the door to BUY MORE TIME in the event of someone challenging your claims.
Bottom line, whether the attorneys didn't think of it, it is IDC's ultimate responsibility to toss the stuff at them and their attorneys to argue it.
