#9654 RE: capted #9653

I would think that the emeralds were cleaned with the paint thinner and what ever other cleaners they used. This whole thing seems like they are saying they CLEANED the emeralds with thinner. And you are saying they enhanced them with thinner?
So if Jay and Steve say they didn't enhance the emeralds they would be right, they only cleaned them.
If you are calling cleaning the emeralds enhancing the emeralds you are then right.
It really sounds like a play of words to me. I say not knowing any better Steve cleaned the dang things and left thinner on them! Big deal, onto the next problem.

I guess we'll see. But why is this dragging out still? C'mon already, the judge has had two shots at this. I think that the judge is making a concerted effort to buy time, again. He did it from day one, defending the Fisher's right to the gems stones. He is doing it again here. You are stating that this will be dragged out. It is just a mere continuance for me.

I still think that the enhancement is BS, and matters little. How does it affect the outcome? Ownership? Actual value? It doesn't, because the case is to sort out whether the judge thinks his friends are owed a stipend for their troubles.

1) do the gems belong to Motivation and at any time did it look (in truth) that they could have come from the Atocha?
Given the information presented from both sides in a US court, the answer is no. And regardless of who was portrayed as victimized, both sides, not just one, expended time and effort defending their position. So this case should be closed.

2) why does the judge want to take the gems or the admiralty claim away? No site? No ship? Again, c'mon already. It makes no difference. The gems exist. They came from somewhere. The judge can't prove one way or the other.

YEA YOU ARE LIKELY CORRECT. But it makes absolutely no difference what you feel about one side here. Does the damn judge have proof or not? The answer is no. Let it go, and Jay will make his own way, as will Silverstein, and all the friends of JTR Enerprises. If the regulators want a shot at this then let's move on to that without this judge.

I understand that there is no wreck in that area. I understand the prominence of the Atocha (and the Margherita?). But to beat a dead horse on these gems has one major flaw.
If they are worth millions, and the vast volume couldn't possibly have placed them as stolen from any particluar known site- they belong then to Jay. If they are worthless, then they still belong to Jay. The judge is chasing his tail. And for no good reason except a grudge, or he is caught in the moment.

Silverstein is presenting himself in a way that he is not willing to lose all that he has over these gems. Agree? If he said anything terse to someone, it is understandable. It is understandable if he seperates himself from Jay in this, or backs JTR in this. I find it hard to believe that any weight is placed upon his words toward an archaeologist or anyone else, when frustrated about the situation at hand. Re-read his affidavit. Man has a great knowledge of what transpired. No one else has stepped up to the plate like this guy.
