I addressed the Defendant issue. Anyone can be listed as defendant.
The bank could have listed you as a defendant, upon filing, if it wanted. Would not hold, of course.
And again, the summary judgement, the document of the case to which you refer, only lists the Gurbas as having liability.
Bulova Tech is not mentioned.
Bank listed Bulova Tech as defendant because Gurbas borrowed money to fund Bulova Tech operations, and bank offered Bulova Tech a $6.5 million line of credit (to also absorb the smaller personal Gurba loan) which it failed to deliver on, and bank will try to get its money any way it can in court, so it listed Bulova Tech inclusive.
Judgement was against the Gurbas only, and as a personal to business matter only.
