Deal can't close sooner than today.
Sept 20th notice sent to shareholders. Shareholders have 20 days to exercise their rights before deal can close.
The 20 days later is today October 10th.
And deal closing could take longer too.
And buyer can cancel within two weeks after consummation of the deal.

The lawsuit was resolved with a summary judgement.
It was a personal financial matter where judge understood Gurba's decent intent, yet the law favored the plaintiff.
Gurba has now requested a reconsideration of that summary judgement decision.
