I don't disagree with that reasoning either. Guess we'll find out shortly. Often a judge will bend over backward to allow the complaining party's motion to make an appeal less likely to be successful.

How much of a hardship for Amphastar would it be to defer soliciting bids until such time as Amphastar is allowed to sell product? Not much, IMO

The claim in Amphastar's memo in support of the emergency motion is that the GPOs have a deadline for submitting bids and it is prior to October 20.
