Would not be unreasonable to grant the allowance for bids as long as no product shipped.

You could be right, but I’ll be surprised if the Judge buys this argument. How much of a hardship for Amphastar would it be to defer soliciting bids until such time as Amphastar is allowed to sell product? Not much, IMO.
