The claim in Amphastar's memo in support of the emergency motion is that the GPOs have a deadline for submitting bids and it is prior to October 20.

I presume that the cited deadline is in reference to submitting bids for 2012 insofar as most GPO contracts run on a calendar-year basis. If so, I highly doubt that Amphastar would be barred from bidding on contracts after Oct 20, which is more than two months before the end of the calendar year.

Does it ring true, IYO, that Amphastar’s purported deadline for bidding on GPO contracts just happens to be the day before the existing TRO expires? Give me a break!
