You could be right, but I’ll be surprised if the Judge buys this argument. How much of a hardship for Amphastar would it be to defer soliciting bids until such time as Amphastar is allowed to sell product? Not much, IMO.

Except that allowing bids might be considered "marketing". Of course, NVS could fix that by agreeing it is not.
