Malko: If NOK is being investigated for misrepresenting their numbers (presumably affecting any award amount), can the ICC go back and reevaluate the award or even change their decision? Anyone?
that the ICC would delay that long if at all, but if the ICC delayed because of inaccurate numbers from NOK, wouldn't that suggest (more likely than not) that Interdigital had won some sort of payment from NOK and that the amount had to be adjusted because NOK failed to file accurate sales numbers?
Good to see you posting. Hope you are feeling better!
Perhaps you could answer some question dealing with ICC's procedure.
1. After the boys in Paris finalized their decision---assuming that occurred 5/31/05, what appens next? It suggested that ir goes to each arbtitration for them to sign--is that correct? Is it then sent to the lawyers?
2. At the ASM WM said that it is rare that the ICC would answer questions by IDCC by way of telephone---because the ICC could not be sure it was in fact IDCC. Does that sound reasonable? Does all communications have to go through the lawyers?
3. At the ASM I got the impression that IDCC was as disappointed as the rest of us---does that sound reasonable?
BTW I got the impression that Harry thought it was in the bag!!! I feel now that it is just a matter of time.
malko14, wouldn't ICC inform the parties if something like this (the delay due to re-calculations or evaluations) has happened. I guess IDCC mentioned that they haven't heard anything regarding the arbitration from ICC. These 2 things are not fitting together. Please comment. TIA for your insight.
