One correction? When you say 'deficiencies' do you mean that you believe it was deficient or as WM has said addresses ANY possible deficiencies argued by NOK when he said that they WILL pay and that we think we won but a loss wouldn't be the end and we had filed new contination patents addressing issues raised by NOK in the ITC and that we have plenty more patents to throw against the wall anyway so one way or another sooner or later NOK and other infringers are gonna pay...

Infinite_q, thanks for that analysis...

I'm glad you're on our side. I bet Nokia really regrets not signing with IDCC back in late August of 2009. They could have probably gotten a great rate on both 3G and 4G at that time (just after the ITC ID came out). Now they may not even be able to get a license, or if they do....they will have to pay through the nose.

New '406 patent in ITC action...

This is a new one. Haven't seen this in the suits before.

Patent 7,502,406 covers a very fundamental aspect of power control - using a series of power control bits from the base station to the UE, to increase or decrease the power transmitted by the UE. There are method claims and structural claims that apply to the UE. I'm not sure which independent claim they will assert, but this one is representative of the claimed invention:

15. A code division multiple access (CDMA) subscriber unit comprising: a despreading and demultiplexing device configured to recover a power control bit from a downlink control channel, wherein the power control bit having has a value indicating a command to either increase or decrease transmission power level; and gain devices configured, in response to the received power control bit, to adjust a transmission power level of both a traffic channel and a reverse control channel prior to transmission by the subscriber unit, wherein the transmission power level of the traffic channel and the reverse_control channel are different.

There are several patents in the new ITC action related to the old '579 patent in the prior suit.

The 7,536,013 and 7,349,540 patents are both related. I haven't reviewed all the patents yet so there may be more.

Here is claim 1 from the '013 patent, which clearly addresses the UE, and speaks to the actual generation of the scrambling sequence for the HSSCCH channel...

1. A wideband code division multiple access (WCDMA) user equipment (UE) comprising: circuitry
configured to process a high speed shared control channel (HS-SCCH); and circuitry configured to
process a high speed physical downlink shared channel (HS-PDSCH) associated with the HS-SCCH
when the HS-SCCH includes information processed with a user specific scrambling sequence associated
with the UE; wherein the user specific scrambling sequence is a result of a 1/2 rate convolutional
encoding of a UE identification (ID).
