Regarding Barrick reporting lawsuits or indictments.
I’ve got a little info out of an attorney. Obviously, they couldn’t address a hypothetical situation, but from my understanding an indictment, at least in certain circumstances, may rise to the level of requiring disclosure to the SEC per Item 401(f) of Regulation S-K, which is typically provided annually in proxy and/or 110-K filings.
As for disclosure of the lawsuit Barrick Andy Lloyd mentions in that stockwatch news report. Barrick should disclose that lawsuit in the Annual report if the outcome shows loss that’s material or in some circumstances potential loss that would be material.
This is the best I can provide on this, not sure if anyone else has something more to bring forward on this subject.
