I surely hope that Sargent and Ard reply to the discovery request with the fact that it will take an extremely long time to sort though the massive amount of useless documents dumped on the EC by the Debtors during the original discovery request by the EC. Furthermore, that they are not sure if any such documents even exist and even if they did, how they would go about finding them, but they intend to do thier best. Wouldn't that be just plain ironic?
I thought Wringling Bros. was the "greatest show on Earth" but they pale in comparison to BR's desperate attempt to maintain any control in this bankruptcy.
BR knows that he cannot risk producing any valuations or asset ownership evidence, without first seeing PJS's numbers. He is showing signs of desperation with his latest filing. When you challenge an adversary's facts and then 15 minutes later are told by the Judge that you need to produce your own, well, lets just say that your threat didn't carry much weight. In fact, your bluff was just called. BR's now trying to sneak a peak at his opponents hole cards, rather than playing the cards he delt himself.
I have a feeling that he will be more than willing to delay resubmittal of the newly amended 6th modified, slightly updated, barely changed, minutely tweaked, polished, reformated, alter and absolutely final DS (which BR reserves the right to change) for the POS POR, until they recieve the requested documents from the EC. IMO, confirmation hearing date will likely be pushed back, to allow time for voting on the plan, which will be push back because the final version of the DS must be approved prior to voting, and no DS will be produced until BR knows PJS's numbers. BR likely does not realize that by opening this discovery process, he inadvertantly will give much more time to the EC to fortify thier case against the hedge monkeys (but, that's the type of stuff that happens when you start making mistakes and play defense instead of offense). He may not want to settle with equity, but he is risking losing complete control of this case if he continues down the current path. Good for me, bad for him and his cronies.
To all longs, good days ahead as more stones are thrown in the glass house the Debtors have built.
