Firegiant, by its own policy, the SEC does not privately disclose the investigatory status of any company to investors, brokers, analysts or the press. The Commission only communicates investigation status via public announcements so that everyone is able to receive the information concurrently.
Sometimes company insiders, their attorneys and/or investor relations firms may be aware that there is an apparent investigation due to being questioned by the SEC, but these investigations are all confidential until such time as the SEC publicly announces any action it has filed.
The SEC NEVER gives a clean bill of health opinion about any company nor does it privately reveal whether or not an investigation may be occuring.
Investigations by the SEC
The SEC conducts investigations confidentially for two main reasons. First, we can conduct investigations more effectively if they are not announced publicly. For instance, important documents and evidence can be destroyed quickly if people hear of an investigation. Second, investigations are kept confidential to protect the reputations of companies and individuals if we find no wrongdoing or decide we cannot bring a successful action against them. As a result, the SEC will not confirm or deny the existence of an investigation unless, and until, it becomes a matter of public record.
An investigation becomes public when the SEC files an action in court or in its internal administrative process. You can find information about public enforcement actions on our website.
If you want to claim that the SEC is communicating with you in ways that are contrary to its published public policy, please post the name and contact information of the person or persons who are supposedly providing this information regarding SMPP so that others might try to verify your claims. Otherwise, people should rely upon the SEC's policy and disbelieve any claimed private information being released about SMPP by the SEC.
