According to Kesha Handy (Victim Witness Coordinator) of the United States Attorney’s Office (USAO), both James Roland Dial and Evan “Nick” Jarvis pleaded guilty before the Southern District Court of Texas in Houston on Friday, March 4, 2011. Their Sentencing Hearing is currently scheduled for Monday, June 6, 2011.



Alex Ellerman is scheduled to plead guilty before the Southern District Court of Texas in Houston today (Tuesday, March 8, 2011), and his Sentencing Hearing may either be included as part of the one for Dial and Jarvis or scheduled for a completely different date (it will more than likely be the same date, though, to keep it simple).



Once all three defendants have pleaded guilty and have been scheduled for a Sentencing Hearing, the USAO will issue an official letter to victims on record after about 10 days, requesting that they supply an Impact Statement to the attorney on record (John Lewis), outlining with supporting documents how much money they lost.



Upon receipt, each Impact Statement, along with all supporting documents, will be handled on an individual basis. All claims will go before a Probate Court in consideration for restitution.



Moreover, if any victims were inadvertently left off the USAO official record, then all that these victims have to do is to contact: Kesha Handy (Victim Witness Coordinator), either by: 1) Mail at United States Attorney’s Office, Post Office Box 61129, Houston, TX 77208-1129; 2) Phone at (713) 567-9335; or Fax at (713) 718-3389. Each claim will be handled in the same manner as all other claims (with a formal Impact Statement and all supporting documents).

Unfortunately I totally disagree. Our government and system of justice is to a great degree a failure.

To think our government is as it should be is the same naive thought pattern that allowed us to be suckered to begin with.

Just remember this the net effect on this case from government has been bad: remember being forced to buy at inflated prices CTBG due to distribution joke.

Extraordinarily shameful.
