It's unusual not to have a Markman ruling...as most cases I have followed at the ITC have a Markman ruling (note: some don't have a Markman hearing like almost all District Courts do), but they still publish their claims construction (which I generically refer to as their Markman ruling).
I have known about IDCC for several years because Rick Currin, a friend of mine, covered them for Fred Hager. But I didn't start following IDCC closely until right before the ITC initial decision came out in August 2009, so I had no idea how that ruling was going to go...because I had not attended any of the pretrial arguments or the actual trial and I had not read very many (if any) of the briefs or transcripts. However, I did make the following two posts on the Rambus iV board a year and a half ago (the day ITC ruling came out) and I think I nailed what happened after the ruling in both posts. I even called the bottom two months before IDCC hit $18.41.
It's worth paying attention to what happens next at the ITC, as we can now see at least one very similar case. If IDCC gets hit as bad as Tessera, I guess it is possible for IDCC to drop into the high teens....but if it does, that would be an excellent point to buy just based on current earnings (which won't go away because of this ruling).
I read that transcript of the IDCC CC and I came away with the feeling that they knew they could lose at the ITC and they were doing damage control before the event. I think much of what they said is true...they have a lot of other 3G patents that weren't in that case. Samsung must have realized this and signed on what they believed to be favorable terms.
You made an astute observation about the claims construction....which in Rambus' case went their way by close to 100%. IDCC is a great company with a great current revenue stream (and future revenue potential for 3G, 4G as well as non cell phone markets).
I think they would be a fantastic buy at 18-19....if they dip that low.
