I can confirm LTG's info as I also spoke to Mr. Denk today.
Air permit to be issued within 'days'.

Sounded to me like they are leaning toward letting JBI operate on a 'temporary' basis so long as JBI in good faith peruses the SWP in short order. That will have to be spelled out when the permit is finalized.

Mr. Denk also explained to me that their decision on SWP in that an SWP will better enable the DEC to monitor exactly what waste they are processing in accordance with the air permit.
