I believe that you are wrong. Rule 144 places significant restrictions on shareholders over 10% as beneficial insiders. I will acknowledge that I am not at all expert in this area, so welcome more informed information. But everything about the existing filing suggests a level of transparency. Also I believe that Mr. Tice would need to file a form 3 to be allowed to sell any shares whatsoever.
