Oh and before you can jump on the fact that the SEC will not post their findings, I mean when they lift the suspention which is an indicator that all was found legit with the company or whether they extend the suspention which would mean they weren't satisfied with the documentation they requested or needed.

You can spin it any way you want. The SEC asked for documentation before the suspension. All ACLH had to do was provide that info. Why do you think they didn't supply the info? The suspension could have been avoided. The CEO of a publicly traded company knows better then to not answer when the SEC comes knocking. The damage is immense once a company gets suspended.

Confoundingly, the SEC does not post such a statement. If an investigation has begun, the SEC will neither confirm nor deny.

Further, if the investigation warrants, a Wells Notice will probably be sent to the company (SOP, but not guaranteed). If the company chooses, the company can PR/8K notice of receipt of the Wells Notice, and may choose to respond with a Wells Submission. This is a dicey decision for just about any company...

Bottom line is, the public won't know for sure whether the SEC plans a civil suit unless and until the SEC files such a suit.
