So until the final conclusion from the SEC is posted, . . .

Confoundingly, the SEC does not post such a statement. If an investigation has begun, the SEC will neither confirm nor deny.

Further, if the investigation warrants, a Wells Notice will probably be sent to the company (SOP, but not guaranteed). If the company chooses, the company can PR/8K notice of receipt of the Wells Notice, and may choose to respond with a Wells Submission. This is a dicey decision for just about any company...

Bottom line is, the public won't know for sure whether the SEC plans a civil suit unless and until the SEC files such a suit.
