MV was nice enough to give me a few minutes. Here is what I got: they were out of stock, they aren't willing to not have a back up plan-the goal not to use until shares are much higher but just in case. It is still very doable and they are close with one party (which is why he is on the East Coast), even likely but until it's signed and the money is in the bank. I asked about whether they thought someone might try to buy a stake here to force a merger, buyout-he said they'll know if someone files 5% so if he knew he didn't tell me, and didn't imply any major concern. He clearly thought the increase in shares was a likely vote, his way. The hedge funds/ mutual funds that follow Cortex told him the technology value is low because the finances stink-they need to improve finances. My 2 cents was a real deal will improve everything from these levels, they need to do that- more pipes keep you from going to chapter 11 but you'll have nothing left either way.
