Years ago I actually applied for a job at QCOM, before they really took off. I did not even get an interview, so that shows how skilled in the art I was at that time! LOL.

The problem is that besides the straight technical aspects used to define a patent, legal considerations are involved. For example you mentioned the conflict on how the word "apparatus" in the preamble should be defined. Below is an article that has in Part II a lengthy discussion in regard to Claim Preamble Limitations. IMO it is not for us mere mortals to try and follow the legal convolutions involved.
