I've yet to see anybody prove that someone was in fact paid to bash....

The issue is "give publicity", not whether the publicity is bullish or bearish in nature.

It shall be unlawful for any person, by the use of any means or instruments of transportation or communication in interstate commerce or by the use of the mails, to publish, give publicity to, or circulate any notice, circular, advertisement, newspaper, article, letter, investment service, or communication which, though not purporting to offer a security for sale, describes such security for a consideration received or to be received, directly or indirectly, from an issuer, underwriter, or dealer, without fully disclosing the receipt, whether past or prospective, of such consideration and the amount thereof.

Hey if you ever find anyone willing to pay for good DD...I mean "bashing", let me know. I know a lot of people that would love to be paid for what they've been doing for free for all these years. Be happy to disclose too.

I have seen hundreds of enforcement actions against paid promoters, but I have only seen one enforcement action occur against someone who was accused of being paid to bash. Perhaps paid bashing is not nearly as widespread as many novices on message boards are led to believe. Ever think of that?
