I do not see any malpractice on the part of the IDCC attorneys on this appeal. They filed it originally with statutory jurisdiction over the ITC matters and they passed it on to the 2ndCCA along with the filings and no oral argument was allowed. They literally got caught in a trap and received a bad ruling on the stay IMO.
