I appreciate all of your comments during this trying time. the real problem as I see it is Nokia's counsel has been successful in turning the tables on IDCC in this case. IDCC had been on the offensive at the ITC and now they are on defense at the SDNY and CCA. The burden of proof requirement is a little different on defense as opposed to offense.
We need to turn it back around on Nokia and get out of the position of having to justify our existence to the courts. I would like to see IDCC file a complaint and request sanctions from the SDNY due to the actions of Nokia in IDCC's ITC case with Samsung. Nokia truly did infringe on the rights of IDCC in its case against Samsung and Judge Batts should be made aware of it and tell Nokia to butt out or whe will lift her order requiring the stay.
