There are many ways you can interpret "pending the expedited appeal" and I believe IDCC intentionally made it vague.
If you interpret it as meaning that IDCC is going to wait until after the results of the expedited appeal then IDCC is doing exactly as you suggested.
I believe IDCC made it vague because, less anybody forget, there are still settlement discussions that have made substantial progress going on with NOK.
Loop, I defer to your knowledge on these matters. But one last question, then why would IDCC now move for separation, and why did they originally oppose consolidation, if there is such an advantage to be had by NOK if they separate?
