You can give all the extenuating circumstances that you like....but if I am spending hundreds of millions on Qualcomm's chips, I expect not to have to worry about injunctions. This is especially true since Qualcomm has spent the last fifteen years lecturing the industry about the importance of licensing intellectual property.
How many times has Q stated that if you use just one claim of one patent that you owe royalties?
