The broker/ dealer is obligated to report the short positions on its books to FINRA/ SEC. These regulators in turn are responsible to make the data transparent. Now, if the voting has far exceeded the total outstanding shares, it’s obviously a flag for the regulators to look at. And the company should be making a case with the regulators. I don’t see how the FTDs on naked short positions can be carried for more than a decade !!

Sage, you suggested a valid point. And i dont know what chiug does in real life, but he is a super super smart cat. Amazing brain power with great clarity. I second you on that.This stupid mhra need to go  and jump into a deep cave and stay there instead of putting out these stupid ass statements like we are doing smart processing and improving it by the minute. Well, our lame company need to be equally blamed too. They can shine our science regularly that is coming out everyday, instead of letting andrew do it out of his good heart.  They can hire a college kid to print out the relevant science periodically.  They can talk about their efforts to unearth the naked short issue, instead of saying we assigned milstein to do it. The automation process guy for our company can talk occasionally about his progress. LP need to realize that staying mute is effing the company greatly. she need to own it by being honest and acknowledge the delays at every step. Prove it to the investors, that she is taking steps to avoid them in future. Give something to loyal investors like us.  Company management need to do a better job. The recent news about activated dendritic cells pertaing to breast ca from pittsburg is very powerful. Our company is stupid to let that news pass. Many things can be done to improve the managing style in this quiet period.Iam not a disgruntled investor, just telling the management, there is room for improvement. They can stay silent if its happening in project orbis or else get the papers ready to reach out to other regulatory agencies and inform that to investors in an informal way. We are currently at the mercy of sky, flipper, doc logic and gary’s brain power to guess the steps happening with our company. Disgusting state of affairs. All iam asking is give us some (positive or negative) clues about processing and show your good efforts in other important areas. This is an amazing and powerful drug. Both company and mhra are equally smothering it in a tight box from helping people. Make noise, tell powerful people and press  about our possible treatment answer to cancer. Shine our company in positive light and change the market sentiment. Learn to sell yourself. World is working on marketing. I will not turn negative because i strongly believe in dcvax and already own a few million shares.

Sage, The answer to your question, “wouldn’t it be a simple exercise to tally up the shares versus the official outstanding shares and bring that to the SEC’s attention?” is two parts:

1. The actual vote numbers are hidden. NWBO is not able to see those “extra” naked shares voting and has no access, so it would not be able to tally and submit it to the SEC.

(In other words, the system treats “over-voting” as a processing error rather than evidence of potential criminal activity, ie a way to by-pass SEC laws, ie the FTD reporting clock.)

2. When retail buys through a brokerage, they are buying a legal claim to a mark-to-market financial asset. It is not a specific stock certificate number. They do sum up the number of shares, but it is substantially ownership of a dollar amount.
