Ultimately the law is whatever "we" want it to be. It's not objective like mass spectra from distant exploding galaxies or 5,000 year-old dinosaur fossils. The law is something "we" made up.

The problem is some of the interpretations "we" made up about the patent law "we" made up, jeopardize public market confidence in returns on investment. Much of it displaced anger *ahem* over insulin prices, mRNA vaccines, failed fish oil trials, etc.

The S.C. justices are aware that 'skinny labels" award the generics with an opportunity to reap profits by skirting patent law...and they weaken innovation, as even the solicitor general must be aware...I would not be surprised if the S.C. refuses to take this new suit...A reversal would not be good for the public's interest in the short term by making branded drugs more expensive...and, in the long term, by making new innovative branded drugs less available.

I think most of us understand that the "skinny label" is really a loophole in the HW law, being taken advantage of by generic companies.
