US government / politicians - (managing the 'generally speaking' - most unhealthy (overweight) population in the world - 'KNOWS' - the health issues - are 'top of the table' - and they USE IT everywhere possible - to gain power. ---------------------------
Being a bit cynical'. Had the official policy from the leading politicians being about - 'Living a healthy lifestyle' (exercise - controlling weight) - then the US health budget would have been reduced 'Big Time' - you would have a much healthier / happier population.
But this is not where the money are'. In the end - 'It is all about money' - as Always :)
Zip, Normally I would agree with you about the court not hearing the case. The court has a history of not taking patent cases. I believe they probably will hear this one, because they asked for the opinion of the Solicitor General. Sleven,
The law should have explicitly made it illegal to fill a generic prescription for an approved indication outside the skinny label.
One could counter that by saying that off-label prescriptions would then be impossible. But that isn't right. You could still prescribe the generic off-label as long as it wasn't an approved indication for the name brand.
