JRoon, Yes. The court asked the Solicitor General for the government views on this case. The government said they should take it. It would be odd for them to ask and then ignore the response. I think they will hear the case. In my understanding the Hatch Waxman act is in opposition to patent law. I would be interested to hear the thoughts of the SC on this.
