I assume it works for us

That action - while good for us AND I WANT IT - IMO does not "directly" get the decision back to congress (elected) ---- but rather NEGATES the agency action (not elected) by DECISION of SCOTUS (not elected)

Not saying it - Major Decision - is good or bad as a way to look at MEGA issues

But I am saying - that approach moves certain decisions/actions from an Agency decision to a COURT decision ---- until if and when Congrees (elected) takes it upon themselves to clarify yes or no ---- until then this takes some decision making from an agency and moves it to nine people

Actions by Conservator without Judicial review is against the basic tenet of separation of powers. Each and every action by the conservator should be open to challenges in a court.
