If this ever got to oral arguments, I wonder what the lawyer for Hikma would say if a Justice asked him why they are calling the claims “meritless”.

Hikma would rather not embarrass themselves by disputing the indisputable fraud on the court....unless they absolutely have to.

Same happened when AMRN appealed to SC. Supreme Court came back requiring Hikma reply at that time. It appears to be a more common strategy than I knew before I had to take Law 101 for Dummies as a requisite for investing in Amarin.

marjac, Hikma did the exact same thing when AMRN appealed their case to the USSC. The Court did ask for a response from Hikma which had everybody thinking we had a shot...especially since it was the end of the term and chances of being granted cert increase. We know how that worked out. Here's hoping for better luck!
